These Terms of Service (“Terms”) govern your use of the ClearShip website at clearship.ai and any related services (collectively, the “Service”) provided by ClearShip (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

ClearShip is a compliance intelligence platform for international shipping. We help businesses understand the regulatory requirements — labeling, safety standards, hazmat classification, and documentation — that apply to their products in different countries.

ClearShip is currently in pre-launch. The Service is limited to our website, published compliance guides, and a waitlist registration form. Full product features are not yet available.

2. Information Disclaimer — Not Legal Advice

ClearShip provides regulatory information for educational and informational purposes only. Our content does not constitute legal, customs, or professional compliance advice.

International shipping regulations are complex, vary by jurisdiction, change frequently, and depend on factors specific to your product and situation. While we strive to provide accurate, up-to-date information with proper citations to official sources, you should:

  • Consult qualified professionals — Always verify compliance requirements with a licensed customs broker, trade compliance attorney, or relevant regulatory authority before shipping.
  • Verify with official sources — Use the regulatory citations we provide to check the original source documents directly.
  • Assume responsibility — You are ultimately responsible for ensuring your shipments comply with all applicable laws and regulations.

ClearShip is a tool to help you understand and navigate regulations, not a substitute for professional advice. Reliance on any information provided by ClearShip is at your own risk.

3. No Warranty on Accuracy

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • Regulatory information displayed on the Service is complete, accurate, or current.
  • The Service will be uninterrupted, secure, or error-free.
  • The results obtained from using the Service will meet your specific compliance requirements.

Regulations change frequently. While we monitor and update our content regularly, there may be a delay between when a regulation changes and when that change is reflected on our platform.

4. Limitation of Liability

To the maximum extent permitted by applicable law, ClearShip and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, data, or business opportunities.
  • Customs delays, fines, penalties, or seizures resulting from reliance on information provided by the Service.
  • Costs of procuring substitute services or professional advice.
  • Any other damages arising out of or related to your use of, or inability to use, the Service.

In no event shall our total liability to you for all claims arising from your use of the Service exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

5. Intellectual Property

All content on the Service — including text, graphics, logos, icons, data compilations, compliance guides, and software — is the property of ClearShip or its content suppliers and is protected by United States and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without our prior written consent, except for reasonable personal or internal business use consistent with the purpose of the Service.

Regulatory text and citations referenced in our content remain the property of their respective government or regulatory bodies. Our compilation, analysis, and plain-language summaries of regulatory information are our original work.

6. Account Terms

When the full ClearShip product launches, the following account terms will apply:

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account and password.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 16 years old to create an account.
  • One person or business entity may not maintain more than one free account.

Currently, no account creation is required. The waitlist only requires an email address.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Scrape, crawl, or use automated means to access the Service or extract data without our written permission.
  • Attempt to interfere with, compromise, or disrupt the Service or its infrastructure.
  • Resell, redistribute, or commercially exploit information from the Service without authorization.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms or conduct that we reasonably believe is harmful to other users, us, or third parties.

You may stop using the Service at any time. If you would like us to delete your data (e.g., your waitlist registration), contact us at legal@clearship.ai and we will process your request within 30 days.

Upon termination, provisions of these Terms that by their nature should survive — including intellectual property, limitation of liability, and the information disclaimer — will remain in effect.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

10. Changes to These Terms

We may revise these Terms from time to time. When we make changes, we will update the “Effective date” at the top of this page. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
